Website Terms and Conditions
Welcome to SEQ Web Design Studio. These Terms and Conditions outline the rules for using this website and the general terms that apply when enquiring about or using our website design, website maintenance, SEO, branding, and related digital services.
By accessing this website, submitting an enquiry, requesting a quote, or using our services, you agree to these Terms and Conditions. If you do not agree with these terms, please do not continue to use this website or our services.
1. About SEQ Web Design Studio
SEQ Web Design Studio provides website design, website development, website maintenance, SEO support, website make-overs, logo design, and related digital services for small businesses and organisations, mainly across South East Queensland, including the Gold Coast and Brisbane.
In these Terms and Conditions, "we", "us", and "our" refer to SEQ Web Design Studio. "You", "your", and "client" refer to the person, business, organisation, or representative using this website or engaging our services.
2. Use of this website
You agree to use this website for lawful purposes only. You must not use this website in a way that may damage, disable, overload, or impair the website, interfere with another person's use of the website, or attempt to gain unauthorised access to any part of the website, server, or related systems.
The content on this website is provided for general information only. While we aim to keep information accurate and up to date, we do not guarantee that all website content will always be complete, current, or error-free.
3. Quotes and project proposals
Any quote, estimate, or proposal provided by SEQ Web Design Studio is based on the information available at the time. If the project scope changes, additional pages, features, integrations, revisions, or services may incur extra costs.
A project is not confirmed until both parties agree to the project details, pricing, inclusions, and payment terms. We reserve the right to decline a project if we believe it is not a suitable fit, is outside our skillset, or involves content or activity we are not comfortable working with.
4. Payments, deposits, and invoices
Payment terms will be outlined before work begins. Depending on the project, we may require an upfront deposit, milestone payments, monthly payments, or full payment before delivery.
Invoices must be paid by the due date stated on the invoice. Late payment may delay the project, pause work, affect website launch, or result in suspension of ongoing services until the outstanding amount is paid.
Unless otherwise stated, all prices are listed in Australian dollars.
5. Client responsibilities
To complete a project properly, you may need to provide content, images, login details, business information, feedback, approvals, or access to third-party services such as domain providers, hosting platforms, Google accounts, email platforms, or website tools.
You are responsible for ensuring that any text, images, logos, videos, documents, or other materials you provide are accurate, lawful, and that you have permission to use them. We are not responsible for copyright, trademark, privacy, or legal issues caused by materials supplied by you.
6. Project timelines
Any estimated timeline is an estimate only. Project timelines can be affected by client feedback, content delays, changes in scope, third-party issues, technical problems, or delayed approvals.
We aim to complete work in a reasonable timeframe, but we are not responsible for delays caused by incomplete information, late feedback, unavailable third-party services, or circumstances outside our control.
7. Revisions and changes
Projects may include a reasonable number of revisions depending on the package or agreement. Revisions are intended for refining the agreed design or content, not for starting the project again from a completely new direction.
Additional revisions, new sections, new pages, design changes, content changes, or extra features outside the agreed scope may be quoted and charged separately.
8. Website hosting, domains, and third-party services
Some projects may involve third-party services such as domain registrars, hosting providers, CMS platforms, Shopify, Google services, analytics tools, email platforms, booking systems, plugins, apps, or payment providers.
Third-party services are subject to their own terms, pricing, policies, updates, downtime, and support processes. We are not responsible for outages, price changes, account issues, service changes, or technical problems caused by third-party providers.
9. Website maintenance and ongoing support
Ongoing support, maintenance, hosting, edits, updates, or SEO services are only included if they are part of your agreed package or ongoing plan.
If you do not have an active maintenance or support plan, future updates, fixes, edits, or technical support may be quoted separately.
10. SEO and results
We may provide SEO setup, content structure, technical improvements, local SEO support, or general search visibility improvements. However, we do not guarantee specific Google rankings, traffic levels, leads, enquiries, sales, or business results.
Search results can be affected by competition, location, website authority, search engine updates, content quality, backlinks, Google Business Profile performance, user behaviour, and many other factors outside our control.
11. Intellectual property
Unless otherwise agreed in writing, once full payment has been received, you may use the final completed website, design assets, and content created specifically for your project for your own business purposes.
We may retain ownership of reusable code, frameworks, processes, development methods, templates, tools, design systems, and general know-how used to create the project. These may be reused in other projects where appropriate.
You must not copy, resell, redistribute, or claim ownership of any material from this website or our business without written permission.
12. Portfolio and marketing use
Unless you request otherwise in writing, we may display completed work in our portfolio, case studies, social media, website, marketing materials, or proposals. This may include your business name, website link, screenshots, and a short description of the project.
13. Australian Consumer Law
Nothing in these Terms and Conditions is intended to exclude, restrict, or modify any rights you may have under the Australian Consumer Law or any other rights that cannot legally be excluded.
Where services are supplied to consumers under Australian law, those services may come with automatic guarantees, including that services are provided with due care and skill, are fit for purpose where applicable, and are supplied within a reasonable time where no time is agreed.
14. Refunds and cancellations
Refunds are assessed case by case depending on the type of service, the stage of the project, the amount of work completed, and any costs already incurred.
Deposits, completed work, third-party costs, subscriptions, domain fees, hosting fees, software fees, and time already spent on a project may not be refundable unless required by law.
If you cancel a project after work has started, you may be required to pay for work completed up to the cancellation date.
15. Limitation of liability
To the maximum extent permitted by law, SEQ Web Design Studio is not liable for indirect loss, loss of profits, loss of revenue, loss of data, business interruption, reputational damage, or any loss caused by third-party services, client changes, unauthorised access, website downtime, search engine changes, or misuse of the website.
Where liability cannot be excluded under Australian law, our liability will be limited to the maximum extent permitted by law.
16. Links to other websites
This website may contain links to third-party websites. These links are provided for convenience only. We do not control third-party websites and are not responsible for their content, security, policies, or services.
17. Cookies and privacy

18. Changes to these terms
We may update these Terms and Conditions from time to time. Any changes will be posted on this page. Your continued use of this website or our services after changes are published means you accept the updated terms.
19. Governing law
These Terms and Conditions are governed by the laws of Queensland, Australia. Any disputes will be handled in accordance with the laws and courts of Queensland, unless otherwise required by law.
